A 30-year-old man was taken into custody and charged with an OWI after being involved in a crash that took place at about 8:30 p.m. on Sept. 1 in Sheboygan. The accident occurred at North 14th Street and Erie Avenue. According to authorities, the man was heading south on 14th Street when he hit a traffic light at 14th and Erie Avenue.
After hitting the traffic light, the car hit a utility pole and came to a stop. Authorities said that the man had been taken into custody for using a restricted substance other than alcohol. In the state of Wisconsin, drivers can be charged with an OWI for driving under the influence of certain controlled substances. It is also illegal to drive while impaired by prescription medication.
Those who are charged with driving under the influence of any substance may contact an attorney immediately. An attorney may cast doubt on evidence such as a breath or blood test that revealed drugs or other substances in a driver’s system. The lawyer might also argue that a driver was experiencing a medical emergency that made it look like they were impaired.
If successful, it may be possible to avoid some or all penalties related to an impaired driving charge. This may mean a driver doesn’t receive a license suspension or has to spend time in jail or prison. Instead, a plea bargain may allow an individual to simply pay a fine or spend a period of time on probation. In some cases, it may be possible to win a full acquittal and be subject to no penalty at all.
