Wide receiver faces 2nd DUI within 5 years

Wisconsin football fans who follow the Green Bay Packers may have heard that Arizona Cardinals’ Michael Floyd is facing DUI and related charges following an incident that took place just hours after the Cardinals’ loss to the Miami Dolphins on Dec. 11. A first-round draft pick in 2012, the 27-year-old receiver will be a free agent after finishing this final year of his deal with the Cardinals.

Floyd was taken into custody by Scottsdale police after he was allegedly found asleep at the wheel of his car at 2:48 a.m. on Dec. 12. Before being released from jail a few hours later, he was charged with two counts of DUI, one count of failure to obey a police officer and one count of obstructing a roadway. The engine of Floyd’s vehicle was reportedly running when police arrived at the scene.

Floyd has now been charged with drunk driving on two separate occasions within a five-year period of time. Sources report that he received the first DUI in 2011 at Notre Dame. The case has not yet been resolved, but if Floyd is eventually convicted on the latest charges, he could face a two-game suspension under a rule that was implemented by the NFL in 2014 in addition to any penalties that could be imposed by the court.

Because penalties for a subsequent drunk driving conviction could be severe if the prosecution obtains a conviction, people who find themselves in a similar situation may want to seek the representation of an attorney who has experience in defending these matters. One possible strategy could be to question the constitutional nature of the traffic stop that led to the arrest.
